While my I-130 is being processed NOA-1 I am completing other forms ahead of time and have some questions. On I-864 Part 5: Not wanting to list my spouse twice as dependent which option is best to leave blank: a. Enter the number you entered on line 10 or c. If you are currently married, enter "1" for your spouse. Since I have filed a separate petition for my wife's daughter (step-daughter) should I also list her as a dependent along with my son whom I support via "child support".

- If the I-864 is to be filed for the spouse, count her in the space where it says "persons you are sponsoring in this affidavit"

- DO NOT count anyone who is not a US permanent resident at the time of filing. Even if you already filed an I-864 on behalf of another relative and there visa is not issued yet, you don't need to count them. Therefore, if the step-daughter is immigrating with your spouse, just assume as you were petitioning for her separately for financial support purposes.

You are responsible under I-864 contract only when the beneficiary becomes a legal permanent resident.
