Hello everyone,

I am needing some outside opinion about our situation. Me and my husband got married last november and finished filing all our documents by January. Everything cam eon time, receipts notices, biometrics and interview notices. We went to our interview on April 20th but there was no decision given. The interview was fairly short. We did mess up in that we brought our wedding album but not other pictures with us. Other than that he asked virtually no questions about our relationship. He only asked "when did you meet?" and seemed not to pay attention to our answer. It is now officially a month and we have heard nothing. I have been checking the status online and it still says "interview" . should I be worried? Should it take this long? Our lawyer and others have told us that by law if they have any suspicions, they have to resort to asking detailed questions about your life together. He asked non except when we met, so I am assuming that he was satisfied, but I am not sure why we are not hearing anything back yet. We are filing and interviewing in Miami in a brand new center. I don't know if any of this could play a factor in the slowness. The thing is that the other steps were not delayed at all, so it makes us really worried. Please let me know if you have any insightful information, I would really appreciate it as we are both becoming very anxious.

p.s. regarding online status - don't rely on it too much - system problems, updates etc. or delayed scans by immigration officers mostly delay any updates online.

Speaking of own experience - my wife's I-130 filed for me with the AOS package is to this day under "initial review" - yet, she received her approval letter as well me my green card almost 4 months ago.

10/17/2010 - USPS confirms delivery to USCIS

10/25/2010 - Check cashed

10/26/2010 - All applications been worked on aka touched

10/28/2010 - NOA1 Receipts for applications received

11/24/2010 - Received appointment for biometrics in the mail for 12/17 *yay*

12/17/2010 - 9.25 a.m. - 9.45 a.m. Biometrics done !!

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/09/2011 - Yup another e-mail saying that my card production was ordered.

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

That waiting time again huh!? I'm sorry to hear that you are kept in limbo right now. I unfortunately can't give you any insightful information, but rather ask you a few more questions and maybe that can help us/me to say that your chances of approval are much higher as there is certain indications during the interview that can be evidence of an approval though it wasn't said by the IO right there and then.

Did the IO take your I-94 and or your EAD, advanced parole and kept it? Was anything mentioned by the IO about the conditional fact of the initial green card (if married recently) aka how and when to file for ROC - removal of conditions?

At my interview the IO didn't keep my EAD or I-94 replacement and so I got somewhat worried yet she mentioned that if approved I would have to apply for ROC 90 days before the card expries which would be early February. I also didn't expect a real approval word right there and then as from reading previous peoples experiences at the office I went to and nobody got the relief "congratulations" right there on the same day in the office.

Can you let us know more details? How long are you married? Did you ever receive a RFE? Did you submit any more supporting documents at the interview whether requested by the IO or on your own? That also can delay their decision for some reason and they might wanna look over the new submissions first - which sucks though if they basically approved you before but now just delay it....

p.s. as far as the online status goes - don't rely on it. Delays are caused by lack of scanning in of your application by an IO when working on it, system problems and updates, server problems you name it. From own experience: my wife's I-130 of my AOS package was approved and I received my greencard almost 4 months ago, yet online it still is under "initial review"

Well first of all the interview was kind of short 30 min or less. He took my I-94 but not my EAD. He mentioned having to reapply after two years or something but nothing of ROC. I have been married since november and we brought wedding photos of us and all our relatives (mom dad, brothers etc). We did not however bring additional pictures, which in hindsight I would have taken. We brought our invitation and even program to our ceremony (he read this carefully). The only thing that worries me is that he asked me at one point about a prior job and address and then asked me if I was married . I began to answer "no" when i realized that I misunderstood him ( he had an accent) and he was asking me if I was married now. I ended up saying that I was married after hestitating. I was worried but he seemed kind of jovial and like he was joking or something. He then asked me my husbands name and that was it. He was very friendly with my husband, making jokes and comments about his hometown, but more cold with me. We showed him our bank account and a loan that we have together and other documents. He reviewed everything but never asked any questions about us. The only thing he asked is when we met, and he seemed to not even be listening when we answered. My lawyer tells me that is a good sign because , by law if there is suspicion they must move on to asking more questions about the relationship. He asked none at all. He said good bye and that he needed to do some internet checks and would get back to us by mail. It has been a month and we have heard nothing, no RFE nothing. I wasn't worried before since my lawyer told me that if the interview was so short and no relationship questions were asked then we were ok. But now I am wondering why it is taking so long. I hope this makes sense.
