Hi All

A have a foreign fiancee fail her interview in 2010 then i found she was cheating on me so i ended the relationship. I have now found someone else and she is a non-us citizen living in her home country. My question is, is there a wait time before you can apply for visa for a different fiancee

If the new I-129F petition is within 2 years of the previous I-129F petiton you have to file a IMBRA waiver request along with your petition. Its basically a signed and dated letter requesting them to allow you to file within the 2 years. You should attach your previous NOA2 approval notice and any supporting documentation.

NOA1 - 12/21/15

NOA2 - 04/18/16

NVC Receive - 04/29/16

NVC Welcome - 05/13/16

DS-261 - 05/14/16

AOS, IV PAID - 05/27/16

DS260 done - 06/10/16

Case Transferred to US Embassy in Riga Latvia at the end of October.

Since you are talking about HCMC, and the denial was just 6 months ago.. the longer you wait to file the petition the better the odds of getting this one approved... The CO will be highly skeptical given the timing. Take your time.. document the evolution of the relationship and make shure this one isn't wrong for you as well.... The consulate wants to see that you have found Mrs right not Mrs right now... :thumbs: regardless of how long you wait, expect a great deal of scrutiny.
