Mom's mispelled name

I plan to petition my mother once i become a us citizen..the problem is her name's spelling on her birth certificate is different on mine. Her name on BC is Rosedilla while on mine it's Rosievilla. I used the correct name on my documents. Is there any other documents acceptable by USCIS? I think mispelled name is very common in Philippines as I had the same problem with my own name but it was corrected and annotated by NSO but I know I can't give this reason to USCIS. Thanks.

February 22, 2011--I-130 Received by USCIS

March 02, 2011-- NOA 1 Received

Can she petition to have her correct name on her own birth certificate?

My fiance had to do this. Then when filling out the Biographic info form he wrote both the correct and incorrect names in the "previously used names" section.

I had a more complicated situation than urs. All i did was see a lawyer and have an affidavit of explanation regarding the issues and had no problem at all.

@Joydee-- she used ROSEDILLA when she applied for a passport 2 years ago (that's the only time she knew that her name was mispelled) so I don't think she can correct it now to ROSIEVILLA since she doesn't have any documents on that name except my and my sisters birth certificates.

@happyblessedme-- what did the lawyer advised you to do? Can you please share? Thanks.

Affidavit of discrepancy at the her local NSO should do it.

Only First name or nickname can be corrected by the city or municipal civil registrar or the consul general due to clerical or typographical error in an entry without needing a Judicial Order.

So for the lastname, she has to go to court to change it.
