What happens if my Mexican fiance living in Canada as a Refugee Claimant decides he wants to go back to Mexico?

We already got our letter stating that the case was transferred to Montreal. As it is, on the application sent to USCIS I had stated that my fiance would pick up his visa in Cd. Juarez, Mexico since we had already discussed him abandoning his refugee claimant case.

Has anyone had a case similar to ours?

So, the case is getting processed in Montreal but he wants to pick the visa up in Mexico? Does he want to go home like, to see his family before you guys get married?

April, 2009 - We met

May, 2009 - We wooed

June, 2010 - We got engaged, looking forward to a small August 2010 wedding

December 29, 2011 - call around for information about delay

January 5, 2011 - RFE notice (first online status update yet!)

January 10, 2011 - RFE Hardcopy

January 13, 2011 - RFE Response acknowledged

January 24, 2011 - NOA2 (at last!!)

February 3, 2011 - application sent from NVC to Montreal (aka. the Abyss?)

March 7, 2011 - Packet 3 sent to me

March 10, 2011 - Packet 3 delivered to Montreal

March 21, 2011 - Packet 4 sent to me

April 5, 2011 - Medical

April 13, 2011 - Interview - approved!

April 20, 2011 - visa in hand

May 9, 2011 - POE (Buffalo, NY)

May 10, 2011 - wedding :)

So, the case is getting processed in Montreal but he wants to pick the visa up in Mexico? Does he want to go home like, to see his family before you guys get married?

The case just got transferred to Montreal on March 4th. My fiance was already planning to abandon his Refugee Claimant Status, and go to Mexico, which is why I put Juarez, Mexico as the place where he would go pick it up. Happens that when he arrived in Canada, the Canadian government took his Mexican passport, and the government only gives it back when he abandons the country, which means he would NOT have a passport to present when he receives his interview date.

Like I said, we were waiting for packet 3, but instead got a letter from Montreal asking for proof of his Canadian citizenship, which of course he doesn't have, or proof of his legal status, which in any case he would send his Refugee Claimant Document which expires until 2013.

We are just concerned about the passport, and in any case, what we would have to do, if he decides he can not wait in Canada, but in Mexico instead. I don't know if Montreal transfers the case...or what.

Ah, that's a tough one... Did you send the paperwork for the Status in Canada request back yet? (I had to go through that too, by the way) If you haven't, maybe you can submit his RCD with a letter explaining that you'd like to complete the K1 process in Canada if possible but that his passport has already been confiscated etc etc.

If you have the whole thing transferred to Mexico, it will probably take a while... though it might not make much difference with how far ahead Montreal interviews are being booked...

Ah, that's a tough one... Did you send the paperwork for the Status in Canada request back yet? (I had to go through that too, by the way) If you haven't, maybe you can submit his RCD with a letter explaining that you'd like to complete the K1 process in Canada if possible but that his passport has already been confiscated etc etc.

No, we haven't submitted any paperwork or documents yet. I called NVC but since the case was transferred to Montreal on March 4th, NVC said I would have to call the consulate to talk to them directly instead. I am thinking to call the consulate before we send his proof of legal status to Montreal. What a brain twister! Lol. I just don't want any more delays. We want to get married sometime in late Summer, or early Fall and all this makes me think we are gonna have some stones along the way. :(

I also thought about sending in the RC ID document, along with a written explanation. I just don't know if it's the proper thing to do. I rather fly to Montreal to be with my fiance, then to Juarez, that's for sure! :unsure:

Well, it's my understanding that Montreal accepts neither phone calls nor faxes, though emails seem to have a somewhat better reputation (I wrote about changing my mailing address yesterday or the day before) but my Packet 3 was sent like 5 days after I submitted my proof of status, so at any rate, they DO open their mail and read what's inside... I guess!

If you decide to include a letter with his proof of status, I'd provide ever possible means of contacting either one of you (including email) and probably encourage the consulate to finish processing the visa application in Canada, to save you guys the trip down to Mexico. I don't know what the best or proper route to take is, but I do wish you lots of success!

I think I will do that, send a brief explanation w/the proof of my fiance's legal status. Hopefully, they will acknowledge it.
