Timeline

We got married in 2010 and I want to file my income tax this year with her include. She currently lives in her country while I am currently get the IR/CR-1 visa process. What steps do I need to take in order to get my income tax correctly file. I also know that they ask for SSN but she currently can't obtain that yet. So can I file for a ITEN on her behalf. Please help me with this. Thanks

You will need to apply for a ITIN number, form w7 ( http://www.irs.gov/pub/irs-pdf/fw7.pdf) and then you will also need to fill out form 2555-EZ (Foreign Earned Income Exclusion). If you plan on getting her an ITIN number for your 2010 taxes you better do very soon , it takes a few weeks to get it.

Here's a post from John who knows a LOT about immigrant taxes and filed with his wife before she was in the US. The ITIN application and tax return go together, not ITIN first.

To get an ITIN, a W-7 has to be submitted along with the completed return to a different IRS address than the one for mailing returns. It takes 6 - 10 weeks for the IRS to assign an ITIN, then they forward it for processing. So if getting an ITIN, e-file is not an option.
