I am getting ready with I-130 and following stages. Could someone please tell me what I need for Police certificate in India...Here is the info.

I got married on Dec.-01-2010. So My wife is staying since then at my place where my native family stays(Lets Call it Town B). Before getting married she stayed all her life in diff. town with her family (Lets call it Town A). We just applied for her passport with her changed last name (Now her last name is same as my last name). Passport should be coming in next 4-5 weeks.

My question is Do I need

Police Clearance Certificate (PCC) from Town A with her pre-marriage last name?

Police Clearance Certificate (PCC) from Town B with her post-marriage last name?

Police Clearance Certificate (PCC) from Passport office?

Thanks...

1 - Which part of India?....Which state you belong to??? Need to have the information to give your any specific information.....but here is the general stuff....

Your passport will only be issued after getting police clearance from TOWN B and also from TOWN A..... Passport Office by law needs this to issue your wife passport...

During NVC process, you need one local police clearance certificate and passport clearenace certificate from Regional Passport Office(RPO).

Local PCC - can be obtained from local SSP office, they will say that she has no bad record from your date of marriage if PCC obtained in less than 1 year of stay.

RPO PCC - Same thing, To give you PCC, RPO will need PCC from Town A and Town B.

Get ready for the long road...

FIRST THING - Passport issued to your wife.... Stay focused on it.

Then, we worry about other things, you have time BUT stay on it to get it ready for NVC state.

Its a good thing you're preparing for getting the PCC ahead and all, but just be aware that you have a while to go before you will need to submit PCCs and all. that doesnt come till the NVC stage. YOu're still in the I-130 USCIS stage. 1st you will need to get your NOA2 which will take 5 months (what it seems to be taking these days, from what I'm reading on here). then comes the NVC stage where you'll be submitting these things.

For the USCIS stage, when applying with the I-130, you DONT need to submit PCC or passport. Just marriage certificate and proof of bonafide relationship is required at this stage.

Btw, the PCC should be done under her married name, since that is the name in the new passport. Under recent rules, you will only need to have a PCC from the regional passport office if your passport has been acquired within the last 6 months; a local PCC is not necessary. Since you just applied for your wife's passport, the 6 month window applies till June/July 2011. The reasoning why you dont need another PCC is b/c the process of getting the passport involves a police check anyway, so no need for another one. But do check with Delhi consulate (assuming that's where you're going to be interviewing).

IMO, you still have a while to go. Also there's another ruling where your PCC from the RPO should be have been acquired within 6 months of the interview date (at least that was the case for the Chennai consulate). So you may not want to get the PCC too early, lest you may require to get a more newer one later on. Just some things to keep in mind.

Best of luck!
