Hey all!

I have read about people getting RFEs for not including their passports, but have you come across anybody who sent a US passport, yet was asked to send in a birth certificate?

I'm asking because we only sent my fiance's (petitioner)US passport to prove citizenship. He's a naturalized American / citizen through his parents (the details are hazy at this point) so if they ask for a birth certificate, we can only send his local birth certificate. He also does not have a naturalization or citizenship certificate. So the passport (with more than 5 years validity) is pretty much all that we have to prove his citizenship.

Thoughts? TIA!

I was recently asked to do the same for my wife. I've submitted everything they've asked for and received a second RFE for an original birth certificate. This happened right after the case was sent to CSC office. I'm a US citizen but I guess that wasn't good enough. If you need a birth certificate, the local embassy will be able to generate one once they validate all the information. Hope that helps

Thank you for the response! I am still worried though whether they will require the birth certificatee as a proof of citizenship, because my fiance's birth certificate is local, so that's not going to prove anything. :(

My fiance has his local certificate I believe. I suppose we should have sent it with the package.

I'm a naturalized USC. I also do not have my Naturalization Certificate available. I visited the local USCIS office on an InfoPass and requested the information to request a new Naturalization Certificate. After they verified that I was who I said that I was, they gave me the form to apply for a new Certificate and gave me the Certificate number. I used the certificate number and submitted a copy of all pages of my passport with the I-129f petition.

If you don't have your Naturalization Certificate available and had at one time applied for a passport, it's a good idea to always make sure that your passport does not expire.

05-17-11 - Applied for Expedited AP as Victoria's mother was very ill; 05-18-11 - Picked up AP document

05-20-11 - Victoria returns to Colombia; NOA1 for all 3 forms arrive

06-03-11 - Text message "Case now updated"; RFE 06-07-11 - RFE arrives for 2010 Tax Return

06-08-11 - Text message "Case now updated"; Post Office returned a letter that was sent by USCIS; 06-09-11 - Issue resolved

06-14-11 - RFE response sent; 06-21-11 - Text message "Case now updated"; RFE response under review

06-29-11 - Text message "Case now updated"; Case transferred to CSC

08-30-11 - Victoria returns to US

08-31-11 - Biometrics done; Text message - "EAD Card Production ordered"

09-11 - Case transferred back from CSC

11-22-11 - Interview in Albany Field Office. AOS APPROVED.
