Hello!

I've recently relocated to the US on my recently issued K1 Visa, and have now married. Yay!

I'm starting on the AOS paperwork. Had some questions about the I-485, and I was hoping some other Canadians recently in the same situation could comment and answer some questions.

I've read the Guide on VisaJourney on filing AOS already. The other forms seem fairly straightforward...Thank you so much in advance for your answers!! They are greatly appreciated.

Initial Evidence for I-485

1. Vaccination Supplement: what do I need to submit?

From reading the I-485 instructions, it states that I need to submit a vaccination supplement. I had my medical in Toronto, and my interview in Montreal. When I picked up my medical results in Toronto, they gave me a sealed envelope, Chest XRay, and photocopy of a sheet of paper entitled "Vaccination Documentation Medical Worksheet Two". Is this sheet (Vaccination Documentation Medical Worksheet Two")enough to submit with my I-485? I called Dr. Seiden's office in Toronto, and I received a phonecall back (from the secretary) saying I needed to take this vaccination worksheet to a civil surgeon in my area, and have the vaccine portion of the I-693 completed by the civil surgeon. I'm not sure that the secretary caught that I was a K-1 Visa instead of a CR-1...Confused. Help! I thought that my medical and vaccination information was in the sealed envelope and already forwarded to USCIS...

2. Do I need to submit police clearances? (I have no criminal history)

Montreal took my originals :( (I forgot to ask for them back), but luckily I have 2 original copies of each document. I have no problems submitting copies of the police records, but it doesn't seem like the instructions ask for them.

3. Criminal History: I have no criminal history. Is it enough to indicate that on my cover letter?

4. Wanted to confirm that my A# is the number they wrote on the back of my I-94, and the number labeled as A# on my K-1 visa (these are the same)

5. Wanted to confirm that the "Nonimmigrant Visa Number" is the red 8 character "number" on my K-1 Visa (starts with C)

6. Should I use my married last name or maiden last name on the I-485/I-765, etc: which causes the least headache later down the road? Eventually I would like to use my married last name, but can wait till I have LPR status if it makes things easier.

7. Do most people in my situation file for Advanced Parole?

My family is a 1 hour flight away from me, so I would just like to avoid any travel at all if possible during the adjustment process. They are okay with visiting me for now.

More on #1 above: should I just go have Parts 1, 2, and 5 filled out by a Civil Surgeon in the area, assuming that the DS3025 was not filled out properly and included in my medical results to USCIS?

I have no idea if the DS 3025 was completed properly, because I was never allowed to open the sealed package from panel physician, or the sealed package that came with my Visa.

Very confused! Please help!

I just found this on the I-693 Instructions:

2. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or

B. as a K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and

C. You received a medical examination prior to admission, then:

a. You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with the terms and conditions on the waiver.

b. Even if a new medical examination is not required, you still must show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit Part 1, Information About You, Part 2, the vaccination chart and Part 5, the Civil Surgeon's Certification, of Form I-693.
