When i finally fly out to the States on the 29th Dec woth my K-1 Visa, i was told i would have to file a Tax Return form for 2010 in the States even though i haven't lived there, is this true or just rubbish.

Did you earn US income? If you worked in the US or for a US company in 2010, then you are required to file taxes in the US. Your post is not quite clear on what you are asking, so I hope this response help you.

ALL US Citizens are REQUIRED to file annual tax return forms. If your income doesn't qualify to be taxed, that is another story. You still have a responsiblity to file every year, even if the return is zero.

When you arrive Dec 29, you would only be obligated to file a 2010 tax return if you earn money in 2010. Since the tax year ends Dec. 31, I don't think that is going to happen.

However, if you marry the US citizen by Dec 31, 2010 (in two days), you may file a joint tax return with him/her because you were married in 2010. That would in most cases lower her tax bill or increase her refund. A spouse does not have to be employed to file a joint return with a working spouse.

Your UK earnings, paid by a UK employer, won't ever be taxed if you paid taxes in the UK. You don't get double taxed.
