Hello all,

We are getting ready to apply for my wife's mother to come from Mexico and become a permanent resident. My wife is a naturalized USC.

The problem is that we are unsure how to answer the question #16 having to with whether your relative has ever been under immigration proceedings - such as removal, Exclusion/Deportation, Rescission, Judicial Proceedings.

A little background:

In 2003 she was coming to the US from Mexico to visit on a Tourist Visa. During the normal questioning and inspection the officers noticed a Texas Drivers License in her wallet that she had had for several years. Which she got legally, she studied, went down and took the test and got the license. They asked her why she had it, she explained that she had a daughter in Fort Worth (my wife) and a son and brother in Richardson, north of Dallas. She explained she had driven while she was her and also back and forth. She had come several times to the US. The officer acknowledged this as they had a printout of all the times she had entered and exited the country. That she said she had never overstayed, or worked here, or anything like that.

They ended up, after talking to a couple different people, canceling her visa and saying that she would have to wait for 1 year to try to get her visa back. Since then she has tried several times to apply for her tourist visa and has been denied every time.

So we are wondering how to answer that question. She was not deported or removed. She was simply denied entrance and the visa was taken away. Does that fall within that question.

We want to answer completely fully and honestly but we are not sure if that is what they are referring to as "immigration proceedings."

Any thoughts would be greatly appreciated.
