Hey Everyone,

So I have a quick customs question! When I got back to Toronto to have our big wedding, do I have to pay customs/duty on my wedding dress? It won't be staying in Toronto because then we're coming back here for our second reception.

Does anyone know how it works?

06/26/09 - Mailed package to Chicago Lockbox!

07/07/09 - NOA's Arrive for AP, AOS & EAD [dated 07/01/09]

07/17/09 - Biometrics Completed [ Completed in 17 Days ]

08/12/09 - EAD APPROVED! Card Ordered! [Approved in 47 Days]

08/20/09 - Interview notice arrived dated 08/18/09 - Sept 24th/09

08/21/09 - Got EAD Card in the mail!! :D

09/24/09 - Interview Date: 9:00am - APPROVED

10/03/09 -Received GC!!!!!

Total Days from NOA1 to Approval : 86 Days

ROC:

04/01/11 - Preparing for ROC currently

06/27/11 - ROC Mailed!

07/02/11 - NOA1 Arrived [dated 06/30/11]

07/13/11 - Biometrics letter arrived [08/01/11]

10/31/11 - Final Approval!

11/04/11 - Received new card today.

Total Days from NOA1 to Approval: 125 Days

Next Step will be citizenship in June 2012!

did you buy it is in the US and you're bringing it to Canada to use? If so, it hardly makes sense you would have to pay duty on it... you don't pay duty on regular clothes you bring with you for a visit.

just my opinion and it could be wrong... that was just my reasoning. hopefully someone else who has done this will come along and answer

October 20th, 2010: NoA2! (141 days)

November 8th, 2010: Received Packet 3 from Montreal

November 10th, 2010: Sent Packet 3 back to Montreal

November 25th: Received Packet 4 & Scheduled interview!

March 8th, 2011: Interview in Montreal - Approved!

April 30th, 2011: Move to CA

May 6th, 2011: Married <3

May 31st, 2011: Filed AOS

June 6th, 2011: NoA1

June 13th, 2011: Received Notice for Biometrics

July 7th, 2011: Biometrics

August 22, 2011: AOS Interview - Approved!

August 29th, 2011: Greencard in hand!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

My understanding is that if the goods are not staying/are returning with you then they're not subject to duty.

I carried my dress through customs in September going to Canada (Pearson Airport) for our church wedding and they didn't say anything about it. (It was in a giant white bag in my arms). It's technically your property so they can't collect duty on it if it's not staying in the country.

They didn't even ask us our reason for entering ths time around... just looked at our customs form and said "Have a nice trip"

Removing Conditions

Sent package to VSC - 8/12/11

NOA1 - 8/16/11

Biometrics - 9/14/11

If you brought it in, you can bring it out without paying duty.

The only reason you would have to pay would be if you bought the dress while you were in Toronto and wanted to bring it back to the US.

I assumed that it should be treated like normal clothing since it's not staying there.

Are you a still a resident of Canada or do you have your status in the US? A Canadian resident bringing any good into Canada purchased from abroad (in this case US)to be used by that Canadian resident in Canada may be subject to duty and taxes. A non Canadian resident can bring their own personal goods into Canada for their use while in Canada.

But also remember if you are a Canadian resident you are still entitled to an exemption depending on your absence from Canada. Gone 48hrs or more you can bring goods back valued up to $400. Gone for 7 days you can bring back goods up to $750.

Just looking at your signature it looks like you have your greencard already, so you would be considered a non-resident of Canada for Customs purposes thus you would be allowed to bring in your dress to use at your wedding as long tax and duty free as it's not going to be staying in Canada. Hope that helps!

It was actually not too bad. I asked to board the plane first so that I could get ask the flight attendant to put it in a closet. They did let me on first with the first calss people. The closets are SMALL. They had to squeeze it and fold the bottom up. It was only an hour flight so it was fine. No one gave me any trouble though going through security either, so that was good.
