I posted this question awhile ago..but only got cynical answers. I'm still hoping someone can help me answer it...I have a friend who has been dating a guy in Jamaica for 2 years now. His mother is here in the U.S and had petitioned for him to come over, during that time my friend and he started dating. They have since decided that they want to be together but are unsure of the route to take...

1)Can they apply for the Fiance Visa (and would it be faster for them) while the family based petition is processing?

2)If he was to be denied for the family petition, would it have an affect on the Fiance Visa?

He (the Fiance) insists that it will be a problem to do the K1 (and he would be denied) while his other petition is processing, so my friend would like to know if that is true and what is the best route for them to take at this point?

Yeah need to know status of other petition not a good idea to be running 2 at the same time that would just look weird

Divorced !st November 2012.

Married only 2 years 1 month
