Hi everyone,

I am planning to file a DCF in New Delhi.. I am aware of the 3 month residency requirement, However do I need a PIO or OCI card for residency requirements or can I stay in india for 3 months on a tourist visa and they will still consider it as residency?

Hi , yes you can live on a tourist visa for 3 months and it will suffice your 3 month residency requirements. But i want to let you know something important. Are you aware of that they are not accepting DCF cases in New delhi?? It was started from March 2010 ,after that its not sure for anybody that they will accept or not. Means after march many cpls are rejected and some of them are accepted.So nobody knows the excat reason behind rejecting application.They told to cpls that you need to go back to USA and do petition over there. In july some cpls are rejected but when we went on 9th August,we were accepted!!! Again i want to let u know the latest news that i heard before 1 week is that one my friend went to new delhi for DCF. On that day also other 4-5 cpls are there. All of them are rejected. Even my friend was also rejected,but he did many requests with that lady officer that his wife is pregnet so plz accept us and etc. So finally they were accepted and others are rejected. So dear ,it depends on ur luck that u will be accepted or not. I suggest you that you do inquiry with New delhi consulate by email or call. And ask them they are accepting or not?? and what are the requirements?? I told u whatever i knows and its fact.Its up tp u what to do. You can take a risk and live here for 3 months and go for DCF and try ur luck and see what happens??? Or another way is u can do petition from USA.

Hi everyone,

I went thru this earlier this year went to Delhi twice. First time, I was told to come back after I meet residency requirement. Second time, I was told I am not a resident of India as I hold OCI. So, they cannot accept my application. They are only accepting applications for USC who works and lives in India for over 6 months. So, I suggest not to waste your time money and effort like me by going there instead just file for US.

My wife just come on visitor visa and she lived here 3 months without any job.And we went to new delhi and we were accepted. So thats not the fact.Nobody knows what the excat reason is. Sometimes they stricly follow the original DCF requirements & rules. Its like a take a risk and see what happens.But now a days as its going on in DCF process ,I Also suggest you that dont waste ur time,money and efforts for DCF.If possible try to do from USA.

Agree with Neal...Take a risk like me and my beautiful wife did we were unlucky to do DCF after 4 months waiting in India i suggest u not wait and go back to USA and start your process if your documents are ready to mail them. do you think if I have a letter from my congressman stating that I moved to india to be with my spouse would help?

May be a plus point but again its risk.It will depend upon ur luck. If you really want to enjoy india life for 3 months with ur wife then live here for 3 month and then try your luck for DCF. If not success then immidiately go back to usa and do file from USA. Best of luck.
