Can someone please help me out. I went for the US Citizenship interview yesterday at the Santa Ana, Calif. office. I have been married for 3 yrs to a US Citizen and when I filed the N-400, I made a cover letter detailing all the paperwork, I sent 2007, 2008 and 2009 Tax docs, bank account and utilities showing both our names. Well, the examiner asked for a title of the house showing my name which I did NOT have because my husband was married before and he had to buy out the ex -wife. When we got married, I felt it was wrong to ask him to put my name in the title because of his past issues.

Now, the problem is, I have 30 days to come up with more legal papers. He does NOT have a Life insurance nor does he have me on his medical insurance since I have full coverage from my job. Has anyone ever faced this issue and what kind of paperwork did you have to give?

Hi,

In general when this subject comes up - I would look at it in parts.

Part 1. what do you have to show co-ownership and joint accounts? This would be the best to submit (which I believe you have already done).

Part 2. Documents that refer to you only, but still show clearly your address (that would match the N-400 and match your spouse's). I would still submit these documents. If your health insurance covers you through your employer and your spouse through his, then I do not see the fault in that - as long as it is saving you and your spouse money, then it is normally the correct path to take. I would submit that evidence and show them that the decision was made due to financial gains.

Part 3. Unavailable Documents - this segment is clearly the worst, but in brief, it is the list of documents that you know you don't have simply because they do not exist. I would list these in a letter and just simply explain the reasoning behind it.

Each of these parts serves a purpose. Reality is reality and you have what you have. The IO cannot request items for you to create from thin air.

In your case, I would include a copy of the title showing your spouse's ownership of the house (without his ex-wife's name). That may have thrown off the IO.

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony
