Ok, I was thinking about AOS. :)

What about from his previous job? What were his earnings from January 2010 up to August 2010?

100% of poverty guideline for a family of 2 is $14,570...still based on current income, not previous year's tax return.

Not a factor.

The I-134 makes the statement..."I am CURRENTLY (employed) and derive an ANNUAL income of _____________________.

If he was unemployed and living in a refrigerator box under a bridge until YESTERDAY and TODAY he gets a job making $45,000 per year and TOMORROW he fills out the I-134...what is his "current income" as of tomorrow? $45,000. Period. He qualifies.

On the other hand, the consulate in Manilla can say "you were living under a bridge until last week, sorry, we are not satisfied with you, visa denied! We do not care that you make $45,000 now, you have a history of living under a bridge"

The consulate in Kiev may say "Bridges are good places to live under...you have your own bridge or is it a communal bridge? Visa approved" In Brussels they will say "Is it a Flemish bridge or a Walloon bridge?" In China they will say "We will approve it but only if your neighbor has the same kind of bridge to live under" See. In Paris they say "Life is good, drink wine!, visa approved! Vive!" No one here can tell you "You WILL get approved" it is not our decision. It doesn;t matter so much if it is 100% or 125% and in your case is is way over either one.

Hs current income is sufficient. Document it. Attach the documents to the I-134 and worry about something else because you and your fiance have done all you can on this matter. It is Manilla and it is a K-1 so a co-sponsor is not more likely to help than a job making $3000 per month. Go with what you have...it is not so bad, really.

I would say that when I handed my documents over at the embassy, their checklist included the affidavit and other supporting documents from sponsor (finace/ee). They asked for tax documents, bank statements and work contract from employer. I would go armed to the teeth with evidence to be certain. Read the embassy reviews, they are very helpful.

hello to all VJRs i am a filipina and i have a u.s citizen fiance.and we filed KI fiance visa, here in philippines us embassy we are required to pass I-134 as affidavit of support. and I read in travel.state.gov that the in applicants using I-134 the income requirement is only 100% of poverty guideline,is this the right information?please help and what is the 100 %federal povert guideline for househodl of 2? thank you so much in advance please help...

I-134 is at the time of the interview. All the evidence with it needs to be up-to-date current time of the interview.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.
