Hi everyone,

First post here. I have some questions about the I-134 and I-864 forms. I am getting married next year to my Fiancee and am applying for a K1 visa at the embassy in London. I am finishing a PhD and have a reasonable amount of savings (60k USD). My fiancee (sponsor) has no assets and, having just graduated, has only started work today as a teaching assistant earning 100 dollars a day. It's as-needed work, you may not work on any particular day but apparently there's a reasonable amount of work to be had. Given that she will only have worked for half the tax year she won't be able to meet the 125% of poverty line. Can I use my assets to show that I would not need welfare for the I-134 and I-864 forms? Can she argue that she would meet the 125% if she had worked the full year but couldn't because she just graduated? Is there any option that I am overlooking??

As for a co-sponsor, I'm not sure what the legal implications are for the person. What are they liable for? Are there any links for this? I don't want to get someone involved in something that has a lot of liabilities.

Thanks for any advise you can offer me. I've looked around online a lot and can't fully understand this situation.

Cheers!

Robin

Check out this page from the London Embassy website regarding meeting the public charge provisions >>> http://london.usembassy.gov/faffidavit.html

It addresses using the immigrant's own funds.

This I-864 FAQ should also be helpful >>>>> http://travel.state.gov/visa/immigrants/info/info_3183.html

Thanks very much for your reply. Great news about the I-134. However, is there any similar provision for the I-864? I read the FAQ and see this "Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?" The answer to the question is in short yes, however they never mention cash assets. Is that included?

Thanks for your help!! I'm sure I can make up the 5 * difference between earnings and 125% of the poverty line using my assets. So this sounds like great news?

Read more carefully and you will learn that you would only need 3X the income requirement ($18,212 for a household of 2) for the I-864 if the assets were in the US. If you have cash then just being it with you (not literally) and Bob's your uncle.
