I am removing my conditions of my greencard and attended a joint interview last week, even though my divorce was finalized a week earlier but I did not want to cancel my interview and I had hope my ex-spouse would attend. He did not attend and I got denied. I have been informed by the immigration officer to refile a waiver and I will be asked to attend a second interview without my ex-spouse.

My question is do I have to pay the full $545, will I be asked to attend biometrics again or will they use the biometrics from my joint filing?

Thank you to anyone who has been through this and can offer any light.

You will have to redo the whole thing from start to finish. Supply a new petition, new payment, new evidence, you are filling based on that your marriage was entered in good faith and then ended in divorce.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Sorry to hear that but unfortunately, you will have to file a new petition and pay the $545.00 again. The old petition is void since it was filed jointly but you guys are actually not "JOINT". File a new one with the divorce decree and evidence proving ypour marriage was not a scam. USCIS will most likely put more light on your case because of the denial but it doesn't mean you can't get it done. Good luck to you.
