DCF-New Delhi still process I-130?

Guys,

Anyone with experience of DCF at New Delhi for I-130?

This option is certainly tempting but how safe it is? Is it worth risking K1 route?

Here is my situation-

1. I am Indian national by birth and recently acquired US citizenship through

Naturalization.

2. Ready to file K1 Visa (I-129F) with USCIS in US for my fiancee.

3. Planning to go and stay in India for 4/5 months on Entry Visa.

My question is-

1. Whether I would be eligible to file for I-130 if I got married in India?

2. What is the residency requirement? How many days?

3. If I am eligible, how the residency period is calculated?

(from date of marriage or my date of arrival in India or date of registration with

Foreigner’s Regional Registration Office (FRRO) in India?)

4. Do I need to be employed in India to be eligible?

5. If I am eligible, when do I apply- at the end of my residency period?

6. How long is the processing time at consulate?

I really appreciate to hear back your feedback......

Hi, we got married in india and we did DCF on 9th august in new delhi. Here are your answers.

1 - Yes, you will be eligible if u will get married in india and stay here for 3 months. BUT i want to ensure you that right now means from last april , new delhi consulate is accepting i-130 sometimes or sometimes not accepting.I heard that 1 of the officer is only not accepting .He says you should have to go back usa and do file in usa. So nobody know what is exact reason why they are accepts sometimes and not sometimes. In our case we did a try and they accepted. As per my knowledge in august (from 1 to 15 aug),they have accepted .So i cant say surely that they will aceept ur petition or not. So i suggest you that plz send an email to new delhi consulate(CIS.Ndi@dhs.gov) and also do more research about this matter.

2 - The residency requirement is 90 days.

3 - Your residency will be counted from your arrival date in india.

4 - I think it is not necessary now. But u get any job then it will be good. Otherwise its fine.

5 - You can apply after 90 days stay. So u can apply on 91th day(if u wish , as we did)

6 - The time processing for DCF is around 3 months. It can vary from 3 months and some more days(like 15 days more).

07-25-14 -> AOS fee Payment.
07-29-14 -> AOS fee shows PAID.

Thanks Nilesh....that was great help.

One more doubt though-

I think at the time of filing DCF they need proof that I withdrew my K1 application.

How to make this call is tricky situation- If I withdraw my K1 application, go to Delhi and they did not accept my application for whatever reason!!

So I'll be without K1 and IR :(

Any advice on this?

Hummm..thats the point. I am dump here... :P . Sorry ,i cant give u any advice here.Same thing happened with us before we went to new delhi.Every day was full of tense...wat will happen?? they will accpet ot not??? Many questions in mind....So think abt it and make some more research .Bcoz there is no excat reason for rejecting DCF. I can say its totally depend on ur luck......so best of luck bro.

Also you mentioned that DCF process takes around 3 months-

Now its 3 months after initial 90 days residency period?

So total 6 months for file to go from Delhi to Mumbai ( it'll be my local consulate)?

and maybe 1 more month to get Interview date.....am I correct?

You need 3 month(90 days) residency to file your petition in new delhi(DCF).And your 3 month will be counted from your aarival date in india.

And after that it will take 3 months more from ur petition filled date in new delhi. So 3 months for residency and around 3 months for ur petition has to be completed(it covers all time...like receiving data forms.....sending back them......medical exams....and others documents to be prepared adn visa interview date.). Thus it can takes around 3 months to get your visa in ur hand.

Only new delhi accepts DCF in India.So you have to must go new delhi. Then they check your case and they will send your this approved case to your local consulate which has juridiction over on your area.If you living in this state ,Gujarat,Goa,Maharashta,MP,Chattisgarh etc...then your consulate would be mumbai.

Lets see below example.It will clarify you much more....... :P

15 sep 2010 - your arrival entry in india

30 oct 2010 - you got married

so you can go for DCF after 15 dec 2010

16 dec 2010 - you go for DCF

after that they will forward case to ur consulate(If your locak consulate is new delhi means same,then u r lucky,ur process will be faster)

16 march to 30 march - between this period you will get ur visa(i hope).

So in this DCF process there are 2 interviews - one at the beginning when the I-130 is submitted to the CIS division New Delhi and the other at the end for the actual visa ?

What is the difference between the two interviews ?

Can you do this on a Visitor's visa - or do you have to have some PIO or OCI status ?

Also, let's say your I-130 petition is accepted by the New Delhi CIS division. Can the US Citizen go back to the USA after the I-130 is accepted ?

I751 Was approved - 10 Year GC was granted

Yes there are 2 interview.But at new delhi ,its simple one...only few basic questions.And the other one visa interview is main.

Yes, you can do on a visitor visa as well as PIO/OCI card.

Yes, USC can go back to usa.
