I have a question on the Ds-156 form. my fiancee was in the U.S. ewi and filed for political asylum and denied ; my fiancee took voluntary departure at the first removal hearing. Does this constitute answering yes or no to the question on the DS-156 ; Have you ever been the subject of a deportation hearing ? This is the second filing and on the first one we answered yes and are concerned that it may be no as she technically was not at a deportation hearing but the first removal proceeding in which they gave my fiancee voluntary departure in lieu of removal. We are afraid that the first time we filed this might have been the reason for a denial on the first filing ; but were not told why? So my question essentially is would this be a yes or no answer? Thanks for any info ?

I can't say I know anything about this topic but it seems to me that the answer would be no. I think it's a good idea to include a cover sheet explaining the situation though just in case. This might be irrelevant now but I was just searching around for any Croatians or Croatian SO to see what their situations were like!

9/21/10--I-129F mailed to Dallas

9/29/10--Check cashed

10/1/10--NOA1 hardcopy received (dated 9/27 and sent to VSC)

Major change of plans - the wait was too long for us and I ended up moving to Croatia in June 2011.
