dear member

i file i 360 vawa back in 0ctober 2008 . i didnt herd from VCS until feb this year when the ask for criminal record after i send RFE they say they will make decision AFTER 60 DAYS that was back in march its been 5 month and no decision however i did inquier about my case thru the senoter and i got letter today saying that my case UNDER REVIEW

any advice any info what under review mean? are they going to denied my petition after 23 month? they never qustion the abuse i send strong evdince

any info will be apprecated

Timeline

Relax....No big deal. They received some info or maybe when they recieved and review your A-file there were some information contrary to what they have right now. So in that case the adjudicating officer on your case has to forward your case to the supervisor for review and decision. What you can do is to ask your lawyer or the senator to write letter to VSC to make decision on the evidence on file. Request for supervisor review so you can move on. I know for sure that something is on your file that trigger immediate decision. Your case definitely need supervisor's review for final decision. Relax gave them 60days then write them and request Supervisor's Review on your case and it might help you to know what really happened with your case. Goodluck!

Timeline

Your case is under what they called "Supervisory Review" It may or may not lead to a denial, it may go to a supervisor prior to a denial being issued. It goes to a supervisor when the adjudicating officer assigned to your case is not sure of what to do. The adjudicating officer wants to issue a denial and wants a denial going to supervisor first for review. On the other hand, the supervisor may instruct the adjudicating officer to Approve the case. That is why it takes so long because they have to review and research the laws, rules and regulations to backup their decisions. Every Denial decision has to have a supporting laws that governs it, incase it went to the Appeal Review. Thats why supervisor has to approved the final decision on a complicated case like yours. Goodluck...Talk to your lawyer right away and brace yourself up incase it turns to Denial.
