Am trying to avoid using a lawyer..could you guys here help out? We are a family of four.. me, bro , mom and dad. Our tax and income are as below. Am trying to sponsor my husband with either mom or dad together with me. Our income and tax info look like below..

my parents file their taxes together..

Parents:

2007

No: of Dep. 4

AGI - $47,791

2008

No: of Dep. 2

AGI - $28, 899

2009

No: of Dep. 2

AGI - $23,589

Current: Unemployed till July

$13.25/hr(40hrs/week) from July

Mine:

2007

No: of Dep. 0

AGI - $12,947

2008

No: of Dep. 1

AGI - $9334

2009

No: of Dep. 1

AGI - $5939 (I won a $10,000 lottery..they deducted some as tax n stuff, finally got $5939)

Current: $786 Biweekly From March 1 2010.. (After all deduction) (Paystubs say 'short-term employee')

1. We live in the same household..does it necessarily mean, my mom/dad has to give me an I864A and not I864? We file taxes separately..

2. and what u guys think of the figures above.. Do i have to look for another sponsor?

125% poverty line for the year 2009 is $32,237 for household of 5. You should look for a sponsor who makes more than this.

Keep in mind that 2010 poverty line may be little higher than this number.

Timeline

125% poverty line for the year 2009 is $32,237 for household of 5. You should look for a sponsor who makes more than this.

Keep in mind that 2010 poverty line may be little higher than this number.

if u dont mind another question, my brother is on his own now..though he still stays in the same address.

How does it become 5? how do they decide how many in household? understand they will count me, husband, mom and dad.. but what info do they have on siblings other than to go by dependents on tax form?

Then your household would be 4, excluding your brother, and combining your spouse and parents.

If they live in the same household, that is, they have the same address as you, they will fill in an I864A.

You may use any and all household members to qualify and your household size will increase accordingly. The combined assets and income must then meet the required guidelines.

Do I need to get I864A filled out by both of 'em..? So my AOS pcket will contain I864 from me, I864A from dad and a second I864A from mom? My parents file their taxes together, yes. But dad is unemployed now and mom working.

Suppose I do go ahead and file as above and if NVC finds I don't meet the 125% level with sufficient certainty this year, what are they going to do? Reject my AOS and ask to find another sponsor and send to them? Or they r going to pass this to consulate where more conditions like bank balance, joint sponsor or anyth else to be produced during interview?

Experts... if my parents file their taxes together, wud it be that both of them need to fill out the I864A for me?

Based on your and your parents' in-consistent income, it would be hard for you to qualify.

Look for any other assets or other strong financial sponsor.
