AOS (1-485) filed after fiance (K1) visa expired

Hi Everyone,

My wife's friend has a situation. She came to USA in April 2010. She and her husband got married in USA in May 2010. They filed for AOS but 2 times it was send back to them due to some error on their end. Now their K1 visa has expired. What should they do now? Is there any penalty for it? Please advise.

There's no deadline to file the AOS packet. As long as she got married within 90 days, she'll be fine :)

It's OK that K-1 has expired. Just have them re-file it and use the guides here, making sure all of the documents are in order so it's not sent back again.
