Question about Removing Condition.

Hi,

ok, I have friend with "2 Years Green Card" based on marriage to a U.S.C , But their marriage it dint less, so she divorced him and he had to move to another state. and he got the final degree, so . now do u think he can still remove condition and get his 10 Years GC? even if his wife divorced him? he married her on faith but i dont know what happend to her to divorce him, anyways. he's working and he pays his own taxes. if yes. can he still apply for his I-751? and which Box he should to check on form I-751, Part 2. Basis for Petition.

and what forms he needs to file with I-751,

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

Yes, once his divorce is finalized, he should immediately file for ROC I-751 and he should check the waiver filing option. If his GC is about to expire, then I believe that he needs to file the same method, and inform USCIS about the pending divorce and then send in the divorce decree when it is finalized.

To answer your question, yes, there are many people who enter in good faith and the marriage doesn't last. These people do get approved once the USCIS officer establishes an opinion for a good-faith marriage.

Your friend must submit evidence related to when they were married to show that they lives together and they were a truly married couple. Anything that can help should be included.... Did they file taxes together when they were married? this is important.

Hi, Yes they did file taxes together and he has alot of evidence like. bills. So now all what he need to do is Fill I751 form? Oh, he never send the divorce decree to the USCIS u know he is new on this thigs, it will be any problem for him? Plus she did divorce him not him, and his GC going to expire in 4 months, Oh sorry what do u mean by "he should check the waiver filing option" anything he needs to file with the I-751 form? or just that form alone ?
