Hi i'm filling out an I-130 for my husband and my father is going to be the affidavit of support because my income is not enough. I'm still filling out an I-864 and my father too but he is right now in foreclusure, shortsale so I don't know if he can still be an affidavit having this problem with the house????

If your father has an income 125% of the poverty level for his household plus the immigrant, then he qualifies. They don't ask if you have debts or foreclosures on the form. Take a look at the form. He doesn't even have to list his assets if his salary is enough and he submits proof.
