II am a little confused still on Section 391 (b) expedited naturalization. I have contacted USCIS twice and received two different answers. My wife has been a Permanent Resident for just over 1 1/2 years. (JAN 09 to JUN 10) She is still on conditional status for about 6 more months.

I'm leaving to Korea in the next 4 months and she will be on official government orders to travel and live abroad with me. My first question, does she qualify for expedited naturalization while still being on conditional status? Second, can I skip the removing the conditional status (over $500) and go directly into getting her naturalized.

I understand the requirements as far as 90 days out, Basic English, proving she will live with me within 45 days of living abroad etc...

Please if anyone can give me a good answer and/or provide the documentation, I would be grateful

The answer to your 2 questions: YES!

I was on conditional status for 15 months. We submitted N-400 along with the RFO, then I fax the official orders after I received it. After 2 months counting from the day that the USCIS received my application, I become a USC.

You mentioned that you still have 4 months left. While working the RFO, make sure your assignment manager list your wife's name.

I don't think so and If I were you, I will not take a chance. This is a naturalization process, do you think that USCIS will accept the application without your wife's name in the RFO? They are aware that it takes time to cut the official orders, that is why they honor the RFO. So the least that you can do is to work on it by explaining your situation to your assignment manager.

To make sure, I asked my husband and he said YES. Just don't forget to fill up the attached form as one of the requirements. And, make sure that your orders has her name on it.
