Can someone help me with the exact instructions for filing DCF. Can my spouse's home in his birthplace be used as an asset? Can anyone tell me what the poverty guidelines are for a family of 2 and what amount is needed if we are to use assets, ie Property and Cash? Also, are there new Poverty Guidelines for 2010. I read that there would be after March 31st, 2010. I would appreciate any assistance at this early stage.

Read this about the I-864 (income/assets) - spouses home can be used, if they meet the conditions as outlined in this FAQ.

This is the most current poverty levels needed for the 864, the 2010 guidelines are not out yet. - for two people, the minimum would be $18,212.00. (assuming you do not lived in AK, HI, or in the military - as they have other values). If your married (as in spouse) then 3X the level is required. (there is some restrictions on assets outside the US, so they will need to be 5X, regardless if your a spouse or not - again - spelled out in the FAQ linked above)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
