I hope someone can help me on my question. I'm a Lawful Permanent Resident currently leaving here in CA and I just got married to a US Citizen. I have a son in the Philippines that is 17yrs of age. My question is how can my USC husband adopt him or bring him here in the US? what is the process that we need to take?. Do we need to do an adoption first or my husband can just file a petition for I-130 right away?. Thank you for your help...

I think the best and quickest way would be for your USC husband to file a I-130 for stepchild. no need to adopt. your son would be considered an immediate relative. hopefully others will chime in

your USC husband can petition him fo as long as you can prove that the married occured before his 18th birthday. You can check I-130 instructions under "What Documents Do You Need To Prove Family Relationship" No. 8

My USC husband petioned my 9 year old daughter who is in the Philippines. We just submitted our papaerworks yesterday. 01/14/11 - Approval Notice I-130 & Welcome Letter!

Have hubby petition your child as IR, then proceed with adoption here. It will take eons if he is to adopt the child in the Philippines as your hubby will need to stay in RP for at least 6 months. We are currently awaiting my daughter's adoption hearing here. STarted the papertrail last September. Lawyer bungled the paperwork. After Child Services did their home-study, we learned that we could've done the adoption process here on our own without a lawyer :blink: Could've been done with the adoption process by now if we did :unsure:

12-11-08 - VISAS RECEIVED....YAHOOOOO!!!

04-07-09 - POE: Chicago O'hare

04-28-09 - received SSN's (after having to apply for them personally!!!!)

04-30-09 - Received our 2-year GREEN CARDS

01-07-09 - ROC, here we come!!!

01-18-11 - Mailed out I-751
