Hi there,

We're pretty much done preparing to file for AOS but are unsure about meeting the poverty guideline requirements.

So my spouse(currently unemployed) has about 4 times the amount required - but 'only' in stocks and bonds... (not sure which ones - e.a. DOW J - am obviously not a financial analyst, sorry).

Has anyone had any experience with this? Can we use this for the I-864 - will that be good enough?

Our attorneys are saying it's no liquid assets and therefore cannot be used to meet the federal poverty guideline.

Please anyone, any advice would be appreciated! Thanks a lot!

Do your "attorneys" specialize in immigration? It doesn't sound like they know what they're talking about. Line 26c is specifically for listing the value of stocks and bonds. The general requirement for assets is that they can be converted into cash within 12 months with undue hardship or financial loss. There is no requirement that the assets have to be "liquid", only that they can be liquidated within 12 months. For a spouse, the combined value of the assets needs to be 3X the shortage in income. Your spouse will need to provide proof of ownership (a brokerage statement will probably suffice), and proof of the current value of the assets (again, the brokerage can probably provide this).

05/01/2013 - Removal of Conditions - APPROVED!

Thanks a lot for your answer. That makes so much more sense! That is exactly what I was thinking at first (but got carried away by doubt). My husband always says he could get the money delivered to his doorstep the next day so I guess we're good in terms of liquidity.
