Can I-129f be submitted while fiancee in US for a visit?

My fiance is planning to visit US this summer. When he is in US, we plan to go thro and fill in I-129f together. I am not sure whether i can submit I-129f while he is still in the states, or it has to be submitted after he left?

Q12 of I-129f form asked about whether the fiance is in US currently (or when the form is being filled in), for my case it will be YES. Is that technically ok?? Cos i am worried they will reject the application cos my fiance is in the US while the K1 application package is submitted.

Is it better to submit the application package when fiance is NOT in USA??

After the submission, he can still visit US for a month or two right?? Is it OK to tell the immigration officer (at the airport) that the K1 application package has been submitted and he visits me in the US for a short time while waiting for the application?? OR he SHOULD NOT mention the K1 application at all to the immigration???

You can submit the application at any time. The only requirement is that he is not in the us come his interview time (how else to obtain a visa?).

As for POE, i do believe they appreciate the truth. They may or may not have records of the 129f on file.

I have visited my fiance a few times since starting the K1 process. I told the Officer the truth when he asked my intentions of my visit to the US.

One Officer did press further after i said Fiance. He asked me outright was i planning on getting married while visiting.

I said No Sir!

He then asked me for proof that i intended to return back to England. (showed him my return airline ticket)

I knew his concern,it was obvious by the questions he was asking. So i mentioned that we planned to do it all in the rightful way via K1. That seemed to reassure the Officer to let me pass through. Few moments later i was hugging my fiance <3

We are so close now to the K1 process being over. Looking forward to the Officer who asks at the end of it all "Do you intend to marry while here?!"

I can say "why yes Sir!.. yes i do.. i do.. i doo hoo!"

I-129F Sent : 2009-10-19

I-129F NOA1 : 2009-10-30

I-129F NOA2 : 2010-01-20

Packet 3 Received : 2010-02-17

Packet 3 Sent : 2010-05-20

Packet 4 Received : 2010-06-23

Booked into Norman Bates Hotel: 2010-07-29

Medical : 2010-07-29 (4 letters issued >.<)

Interview Date : 2010-07-30 (pending medical results)

Email from Embassy: 2010-10-22 They confirm they have medical results, we are under final review.

Courier website : 2010-11-2 shows packet enroute for delivery. 1st indication of final approval! Or is it??! argh the suspense!

Visa Delivered <3 : 2010-11-3 K1 Visa packet delivered by courier! *cup of tea to celebrate*

US Entry (Dulles) : 2011-2-27 Hot Tomales time <3
