Hello to everybody!

Latins and those in love with latins!!

We need a thread to share the experiences, questions, answers, everything is welcome! We can learn about how fast o how difficult are the visa journeys in each latin american country, Spain.. etc.

As for me, Im in Mexico City, I have been waiting for 6 months since NOA 1, but I had an overstay (130 days) and I think that is the reason.. I received the RFE IMBRA too.. already sent it back to USCIS.

Hola Chilango (a),

Overstay should not have an impact on your petition processing - where it comes into effect normally is at the consulate in CDJ. Be sure you have lots and lots of proof when you go to your interview of the exact dates you arrived and left the country because under 180 days = no problem.

I'm baffled on why they sent you an RFE for IMBRA since there was no IMBRA law when you filed.

Pues si, es raro que haya recibido el IMBRA si yo envie mi peticion desde los ultimos dias de enero. Lo que he pensado es que tal vez mi caso estuvo guardado o atorado por algunos meses y cuando lo procesaron por 1a vez, ya requerian el suplemento nuevo. No crees?

You may be right - but it doesn't matter. Your NOA1 date is BEFORE the law took effect. Where does your fiance live? She (he - which is it?) should contact her (his) senator immediately. Go to the senator's website to the section called Constituent Services, download the privacy form, fill out all the information, fax to the senator's office and call to follow up the next day. Ask in the letter what is the explanation for the delay in your case and WHY you received an IMBRA RFE when you are not affected by IMBRA.
