Hi,

I have been in the US for nearly two years now, but my wife and I am about to return home to New Zealand. I got a job opportunity back there.

As a consequence I will be abandoning my US residency. I have had a green card for 18 months now and had I been staying in the US I would be applying this month for removal of conditions on my permanent residency.

My question is two fold:

1. Do I need to let USCIS know that I am abandoning my residency?

2. Will they give me a hard time when I come back to the US for short visits to family?

Hi,

You are abandoning your green card after filing for ROC? If you have plans of coming back someday to visit your family, then abandoning it outright is not a good idea. Go to the U.S embassy in your home country and properly hand it over, sign a a document so they have it on file. That is the only way you can get a visitor visa in the future. If you abandon the card before ROC then your residency in the U.S will be terminated outright.

I hope this helps in both questions.
