Good evening everyone...

Looking for some feed back here form any and all.

We are in month 5 of our application being sent for the 129-F. I'm hoping to hear something back this month but I have a few little speed bumps that might hold things up a little longer then hoped for.

* I had a little legal issue almost 20 years ago but my attorney said this will not get us a denied response from immigrations. At the very most just will need to provide certified court papers... Which is why I am thinking they transfered our case from California to Vermont. ANY THOUGHTS???

* Also I wanted to see if anyone has been successful at getting a tourist visa approved once the application for the 129 - F is in the works?

I appreciate everyones time and thoughts and I wish you all the best and a speedy journey!

1) You'll need to post more details than just a "little legal issue" so that we can give you a better response.

2) Getting a tourist visa is dependent on the country and how she can prove ties to her country showing that she intends to return (like having a job, real estate, leases, etc etc). Check out the Latin American forum down below for more details regarding Brasil's chances on a B2.

Good luck and welcome to VJ :)

I have seen B2 visas being approved during K1-K3-CR1 cases. However, will depend on the circumstances/reasons and how far the current process is.

"Peace is not the product of terror or fear. Peace is not the silence of cemeteries. Peace is not the silent result of violent repression. Peace is the generous, tranquil contribution of all to the good of all. Peace is dynamism. Peace is generosity. It is right and it is duty." -- NAPF page on Oscar Romero

I wouldn't even bother trying to apply for a B2 while a K1 app is in process. Trust me, the K1 takes up enough stress, time and money alone. If I was you, I wouldn't want to complicate things. Depending on what your legal issue is, I'm sure if you've been advised it won't count against you, all will be fine. I hear sometimes they transfer cases to other offices with less workload.

We also called USCIS every day once it got to the 4 month mark, and were about to contact Russ' congressman too, just to see what was happening. Have many other people that filed during the same month as you, been approved yet?
