Hi There,

So, I've been with my NEW fiance since January 2008, we JUST got engaged a few weeks ago and are starting the I-129F process. We visit regularly, and his next trip over this way will be for 4 weeks in July. He has done this ever since we have been dating, but we're worried about the ramifications of him visiting while the visa is processing. He is from England and travels with a "Visa Waiver", so does not need to apply for another visa to get here, only his passport.

Hopefully someone out there who is currently in the same process can clear this up for me. He will be traveling on a round trip ticket, and will be returning to work as a teacher promptly when he gets back to england. Ive heard its wise to have an employer letter stating his current full time employment status JUST in case someone at customs asks questions. OBVIOUSLY he will not mention that he is visiting his fiance. We have maintained to customs over the past few years that we are "visiting friends" when we travel!

Help! Advice! I don't want this to mess anything up!

It's safe to travel

You're doing the right thing.

If you wanted to just get married, you wouldn't have filed the fiancee papers.

I suggest bringing a set of copies of the filed papers in the carry-on.

And yes, I'd recommend bringing ANY proof to show that he will be returning, just to be safe.

Lease of his apartment, employer stating that they expect him back, copy of his contract, and of course, the return ticket. They can see in the computer that you are filing the documents, so him lying about it will not help you AT ALL. So 'visiting friends' may not be a lie, but it's also only half the truth.

I too traveled to see my USA fiancee while papers were being filed. I traveled from the Netherlands.

I brought the stuff just in case. I didn't run into any problems. He shouldn't assume he will, nor be worried.

They're trained professionals. If he seems on the edge, that might concern them more then a confident man, who is following USA immigration laws, and not only filed the right forms, but also wants to still spend time with her since he actually cares ;)
