Timeline

My fiancee has her middle name misspelled on her Birth Certificate. We are applying for the K1 using her name as shown on her BC but under other names used we did put the way she wants it spelled. She also uses this name as her common name and spells it the way it should be spelled correctly. She wants it spelled the correct way when we apply for our marriage license when she gets her to the US. Will this only comlicate things if the marriage license has a different spelling when we apply for permanent residence after we are married?

6/15 & 16/10 Medical Exam at St. Lukes Manila

6/15 Completed day 1 of medical will return in July for day 2

7/1 Appointment for passport renewal Expedited passport

7/16 Passport at DFA

7/19 2nd day of Medical PASSED

7/23 Interview Needs NBI Clearance & CENOMAR with misspelling of her name and then will be approved

7/29 NBI return to Embassy

8/2 CENMAR done should be picked up by Embassy at Pasay on Friday 8/6

8/4 PRISM & CFO completed

8/10 VISA Approved

8/12 VISA Received

8/16 CFO Stamp on Passport

8/18 Arrive PDX Via Tokyo

9/4 Married

1/11 Biometrics

3/10 AOS Interview Portland, OR

Your fiancée could have just followed whatever is shown on her BC. My maiden name was also misspelled in my BC, one letter is wrong but had no problem during the entire process and besides when you get married; her middle name will be useless anyway (unless she intends to keep her maiden name).

It will potentially complicate things and worst; delay the application if immigration notices the different spellings of her name on the documents.

Anyway, every case is different and I am just sharing my experience. Good luck and wish you a speedy process!

I doubt if you will have any problems. I say this because, when you fill out your marriage certificate, the marriage certificate legally changes her name to whatever she wants it to be. After you fill out your marriage certificate, she can start using her new name. At least that is the way it works in our state and that is what my wife did.
