Bryan and I met almost a year ago in a chat room. I have been over to the U.K. to visit him last fall. Bryan in turn came over and spent three months with me. He is returning in a few weeks to spend another three months with me. The week after his arrival we shall be filing the K-1 and taking a deep breath, holding on for dear life and hoping we do everything right the first time. The process is going to be at least 7 months. Of that 7 months he will be here stateside with me the first three of it. He would have been over here at that point approx 6 months with in a years time.

My question is this.....

Will he be able to come back to visit me before his visa is issued. I am dreading that four months. But will deal with it if need be. Hoping not to though. Thank y'all for any input and if I placed this in the wrong place sorry.

I would assume your fiancee will be coming here under the VWP. Here are some excerpts from the VWP page and the link to the US Embassy in the UK:

"Important reminder Visa-free travel does not include those who plan to study, work or remain more than 90 days. Such travelers need visas. If an immigration official has reason to believe that a visa-free traveler is going to study, work or stay longer than 90 days, the officer will refuse to admit the traveler".

My question is this.....

I understand the 90 limit..... my question was can he return after leaving the U.S. for a period of time and returning for another 90 or less visit. And that would be after we have filed for the k-1.....

As Otto and Karen said - the short answer is yes, but re-entry is up to the discretion of the CBP. It may raise some flags that your fiancee is returning again (it will be for the 3rd time) after you file for your K-1, but if he can proove sufficient ties to the U.K. and the CBP doesn't have undue suspicions of your fiancee's intent to return home then he will be re-admitted.

I would advise your fiancee to not get caught with job resumes in his luggage on his subsecquent trips or anything which would make it appear as anything more than a normal visit to see you...
