We've got our CR-1 visa, but the expiration date of the visa is about one week before our 2nd wedding anniversary. Does anyone know, if we extend the visa so my husband arrives in the US after that date, will he automatically get the IR-1? or is it based on the date of the interview?

Also, does anyone have experience asking the London embassy for an extension?

London can issue extensions, but they have to be for extenuating circumstances (like you or a close family member fall ill, or your child needs to finish out a school year). It's unlikely that the timing of your POE to suit your desire for an IR1 would fall in this category, but it certainly does not hurt to try.

I might be able to make a convincing argument...

if we could get an extension, would it matter? I mean, would he get the 10yr green card if he enters after the 2yr wedding anniversary?

Do they count the date of entry or the date you received the visa?

If you enter after your second wedding anniversary, it will function as an IR-1 visa notwithstanding being married for fewer than two years at the time of the interview. The date on the visa is irrelevant -- it's all down to the date of the POE. Good luck -- and come back and let us know if you were successful! :)
