212 (h)(1)(a)- hardship not needed? Can be done @I-485 int?

Hi,

I would like to sponsor my dad for a GC. I am a USC. He has CIMT record going back 33 years ago from Europe. I was told as he satistfies:

212 (h)(1)(a) waiver requirements:

1) it has been at least 15 years since you committed the crime;

2) allowing you into the U.S. would not harm the welfare, safety or security of the country, and

3) you have been rehabilitated (you have changed and do not now commit crimes)

AND since he is a CDN citizen with US I-192 waivers which basically need the requirements 2 and 3 to be satisfied, that he can bring appropriate documentation to the I-485 interview and will be adjudicated there and then. He may not even be asked many questions as to these incidents because he works (H1) and lives in the US for some of the time.

Is this accurate? Has anyone experience either first hand or second hand with such matters?
