My fiancee lives in the Philippines. I was there last in December '09 and filled out all the papers. All I'm waiting on is her CENOMAR to come through the NSO. Can I go ahead and file for her K-1 with just the judge signed annulment papers and no CENOMAR yet?

What stage are you guys at? I am assuming you guys have not started the process yet. First, you would need to file for an I-129F, which is a petition, and once that is approved, you would then have her apply in her country for the visa. In the mean time, this will give you/her time to get the CENOMAR.

Please fill out your timeline as it will he people here assist with questions better.

The CENOMAR is not needed at this stage. She will need to take it with her during her interview. No problem for you to proceed with your K1 now.

as long as you have the annulment in hand you dont need the cenomar yet..you both have to be able to legally marry at the time you file, so if you are waiting for the annulment, then wait longer until you have it, otherwise your fine.

yes like other posters said here, no need for the cenomar yet, u can file the petition(k1) in USCIS, if she is annulled then enclosed the decree on the petition, she needs the cenomar at her interview...

good luck!!! :star:

You don't need your fiancee's CENOMAR when filing the petition. She only needs it during the interview.

Good luck!

The beneficiaries birth certificate is not required simply to file the petition.

CENOMAR is needed at the interview. Not to file the petition.

Our journey together on this earth has come to an end.

I will see you one day again, my love.
