My husband was paid hourly $16/hour, and works 40 hours a week. Sometimes he gets overtime, sometimes bonus. He has weekly pay stub. So his pay stubs vary from $400 to $700, which makes his annual income around $31200 (assuming average weekly pay is $600) .

But somehow his company issues a letter saying he is making $36,000. The HR lady said this counts in potential overtime and bonus. It has a big gap compared to his pay stubs.

Just want to know whether this will cause problem. A gap that we can't back up yet.

1. Are we better off ask the HR lady to match the letter with his current pay stub?

2. With his varying pay stubs, do we need to provide an explanation to help USCIS get it easily.

(note: His 2009 tax return doesn't quality. So we use paystub and employment letter to qualify. )

[April 7, 2010]: Walk-in biometric rejected. They didn't want to do it. [Day 26]

[April 4, 2010]: Received biometric appointment notice - April 20th. Dated March 30th. [Day 23]

[March 26, 2010]: Received NOAs for I-485, I-130, I-756, I-131. [Day 14]

[March 23, 2010]: Checks cashed. Case established on USCIS website. [Day 11]

[March 22, 2010]: Received texts and emails for receipt # for all 4 applications [Day 10]

[March 15, 2010]: Package received and signed by USCIS [Day 3]

[March 12, 2010]: Sent AOS package to Chicago office via USPS Express [Day 1]

[February, 2010]: Married.

[January, 2010]: Engaged.

[May 2008]: Met my husband.

[May 2006]: Changed to H1-B.

[Dec 2003]: Arrived as F-1.

Should be fine... Just explain that the 36k is base salary before OT and you should be fine... The main thing is that he earns the required amount minimum... more is not an issue but if the paystubs were less, then it might be an issue...
