I was under the impression that these were required only if the kids were coming along. We have until May 21. We have friends there working on this. Problem is last year they lost EVERYTHING in a fire.

I would like to know a little more about your case.. my is completed and my kids are in the seccion fallow to joint (ds230)..

did they ask you for their passport, birth certificate?

please advice me!

Maybe some consulates will let it slide if the kids in question aren't coming, but the forms in question do say quite clearly that you need all birth certificates for all children.

When in doubt, always read the forms closely, interpret the written instructions literally, and obey them completely. It may not always be completely necessary, but it is always the safest course.

You cannot get an extension on the RFE request, it even says it on the form. You will have FOUR weeks to submit said information. Extentions CANNOT/WILL NOT be granted.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

Okay, I get it. You ARE an AGITATOR. The form does NOT state NO extension, etc. It states the same as ALL the others. Anybody KNOW what I'm asking? BTW, We NEVER intended to bring the kids HERE. I wanted my wife to have dual cit without breaking up the family. Most of the kids are in schools with no interest in coming here. My wife and I will be moving back there PERMANENTLY next year.

So, again, does ANYBODY KNOW?

Sorry, I did not mean to come off as crass. I am undergoing the same issue as you are having, sort of. I needed an extension for an RFE, and on my form at least it states absolutly NO extentions will be granted. What I ended up doing was getting my wife's mother, sister, and father to do a notarized document, and sent that along with the form, with a letter stating that that was all I could get together in that short of time, and that if and when I recieved more I would be sure to send it in as soon as possible. I am hoping that will work for me, but in your case, you may be able to send what you have with a nicely worded letter that you are having to wait for the local government to send you the kids birth certificates, and that there is a delay for that, but as soon as you get it you will send it in to them ASAP. UPDATE!!

Just got notice of card printing today (05/28/10). One week ago I sent a copy of one birth certificate with additional Fire Certificates from Cebu attesting to the complete loss of all possessions in the fire there. I sent a cover letter explaining the details of the fire with the promise to send the additional birth certificates when we get them. The USNIS had allowed us 84 days to get the five (5) birth certificates. We had decided long ago not to uproot the kids from all their friends and schools and drop them into a completely alien world that would automatically set them back two years in school. Kids need stability to grow and both my wife and I agree that the schools in Cebu are at a higher moral level than those in the U.S. (sorry, but that's the way we see it). I brought my wife here so she could gain citizenship thereby becoming eligible for SSA benefits (especially mine after I’m gone). We can bring the kids over later if they want. My wife and I plan to ultimately retire in Cebu anyway (only a couple more years). It's not out of the question for us to maintain two homes later, one in each country.
