I am going to apply for AOS, but I have been married for more than 2 years. My Spouse was a GC holder when I married and becoming a USC end of this month.

So would I be getting a 10 year green card or

should I attach Removal of Conditions form with my AOS package or

should I still have to wait 3 years and apply for removal of conditions ?

Experts please help.......I saw in many places that if the marriage is less than 2 years, you will be issued a conditional GC, but they never mention what happens if your marriage is more than 2 years.

If I am not mistaken you will be issued with 10 years greedn card therefore you don't need to deal with removal of conditions...

September 5th 2007 Married in the U.S

October 15th 2007 documents were recieved

Nov 25th 2007 biometrics

Dec 17 2007 work authorization

Feb 26 2008 interview and approval

25 Nov 2009 I-751

27 Nov 2009 NOA

11 Dec 2009 Biometrics (early bio)

31 Dec 2009 touch (web site indicates last update)

Is there anyone with similar experience where a 10 year GC was issued instead of the 2 year conditional GC ?

Do they count the 2 years since my spouse became a US citizen or do they count from when I got married ( my spouse was GC holder then )

Yes. IR means Immediate Relative. 10 years so you won't have to bother with ROC.

If you're adding a cover letter, then sure mention that. Since you're AOS, I don't know if they call it the IR-1 visa since technically you don't need a visa as you're already in the States. But you're adjusting your status to that of a LPR, so you will receive your 10 year GC.

That is awsome. My spouse was a GC holder when applied for the I-130 few years back when we got married. Spouse will be USC end of this month,so i have to send only the I-485 with medical and affidavit to get it done. I will keep you guys updated on this issue. Didnt see many people say if they got 10 yrs GC or not.
