Hi,

So I have a valid H1B Visa right now. I will having an official engagement in May, after which we are planning on having a court marriage, so I can apply for an EAD. I do not want to continue to work in the company i am in, and would like an EAD, so that I can quit and be with him. Problem is, We are getting married in India in November, and i understand that to travel i need an Advance Parole. First of all, If I apply in June for my EAD, when can i receive it? Secondly, how long does it take to receive the Advance Parole to be able to go to India for my wedding? Am i right in thinking the following steps?

1. Get a court marriage

2. Apply for EAD and AP

3. Wait, and hopefully get something before November?

Am i missing step? Also, everything has been planned in India for my wedding, and i obviously need to be there. If it takes any longer, we can apply for it now, however there will not be a proof of photos (which we were hoping to get during our engagement).

Please Advise!

By applying for EAD and AP you mean you want adjust status to receive a 2 year greencard.

If you send in your application say June 1st, you can assume that you'll get both your EAD and AP no later than September. However, if USCIS issues a "Request for evidence" prior to issuing the EAD/AP it will hold the case up. So make sure you follow the guides on this site ( http://www.visajourney.com/forums/index.ph...amp;page=guides ) to avoid complications

You will likely be okay for November. Another thing you will need to be careful of is that you do not miss your interview (if you have one) if it happens to be scheduled for November.

Thank you for your response! When you say Interview, you mean if there is a hold up? Also, the link you sent doesn't work, is there anywhere else I can see the guidelines?
