Hi all,

I am wondering if I can file my tax return seperately from my wife because we can't live together and will probably have to decide "divorce". Is it illegal if we do tax filing seperately while we're still married. We still try to work it out, but at this time I don't want to do anything related to hers. Thank you.

No law that says you have to file jointly, can file married filing a separate return, but may lose a few deductions depending if you have any or not.

Depends on what stage you are at. You may lose "points" if you don't file jointly for ROC. Not required tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
