I have been with my fiance since May 2005. I am a british citizen and live in UK. My fiance is a lawful permanent resident. I am currently 6 weeks pregnant and would like to have my child in USA. What are my options on obtaining a visa? I can travel freely to USA on my british passport as a tourist.

Any response would be appreciated.

How exactly do you expect to be allowed in for the purpose of having a baby without insurance... besides the fact of it impacting your and your baby's health by flying so close to delivery...

The CBP is very aware of anchor babies and it will not fly... Have the baby in the UK.. when you're ready to come to the US, he can file for an I-130 for both of you. The baby will be a US Citizen upon entry on the Immigrant Visa.

hey,

thanks for your post. Travelling on a british passport gives me three months to stay in USA. i plan to go there when i am about 7 months pregnant so that shouldnt be a problem with flying. Also my fiance is a greencard holder and not a citizen. Can he still apply for the k-visa or not?

As far as I know, only USC can apply for K-visas. There was another thread about it. Let me find it.

If you arrive here on a Visa Wavier Programe and you are asked why you have come so close to having your baby... you are likely to be refused entry and put on the first flight back to the UK at your own expence.... The VWP does not give you free entry to the States it just means you dont have to file for a tourist visa... but you are still inspected at entry and subject to the same rules as anyone else....

How do you plan to pay for the delivery of your baby.... it is very expensive here...

An LPR/Greencard holder can not file for a K visa... you would have to be married and even then the wait would be a long time....

Lady S - Have you been to the US before? Have you come in before? They are going to want to know WHAT you are doing here, how long you plan to stay and you can bet they are going to notice if you're 7 months along.

How do you plan to pay your hospital bill if you can even get into the country here? You will have no insurance and US hospitals do not except NHS funds and the NHS will not cover your birth in the US.

10/07/2006 WEDDING DAY!

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

I think the best way forward is for my fiance to apply for his citizenship and then go ahead and file for a K-visa for me. One last question, once the k-visa is appoved do we have to get married in USA or can we get married elsewhere??? It has always been our plan to get married in Nigeria which is where our parents are from.

If you get a K-1, you must get married in the US. If that doesn't work for you, you can get married anywhere in the world that you want. Don't know what it takes for a legal marriage in Nigeria, but after that happens you can file an I-130 and pursue either the K-3 visa route or continue for a CR-1 visa. Be aware that the interview for a K-3 visa takes place in the country where the marriage took place. I wouldn't think choosing Lagos for your intervew would be a good idea.

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

October: 13th: Sent off AOS Package

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

I AM TAKING THE ADVICE OF PEOPLE.

WHAT IS A CR-1 visa? AND HOW WOULD THIS BE APPROPRIATE FOR ME IF I DO GET MARRIED IN NIGERIA??

AS stated by Ziggy on your last question

If you get a K-1, you must get married in the US. If that doesn't work for you, you can get married anywhere in the world that you want. NOT REALLY. I TOOK EVEYONES ADVICE NOT TO GO OVER TO US JUST TO GIVE BIRTH. THEN I MENTIONED THAT I WOULD GO THROUGH THE K-VISA PROCESS, AND ASKED IF I COULD MARRY ELSEWHERE OTHER THAN US. I AM NOT REPEATING MYSELF APART FROM TO U!

Ziggy is right, Lagos could be a bad idea. A K1 visa could be the way to go once he receives his citizenship. You would come over with your child on the K1 and you can have a quick, civil ceremony then begin to plan your ceremonial/formal/dream wedding in Nigeria.

You may want to check out the timeframe people are talking about so you understand that it is likely you will have to wait about 2 years before you will get a K1.... about 1 year for him to become USC and then 9 months to a year for you to get a K1....
