Hello all,

My wife filed I-130 in Oct when she was permanent resident. She became USC and I filed foe AOS(I-485, I-765, I-131) in Dec. We also called CSC to upgrade my I-130 case after some delay caused by ignorance of our mailed request to upgrade my I-130 case.

How does the delay in I-130 affects my case for AOS or EAD?

10/29/2009 Check Posted for I-131

10/31/2009 NOA-I

12/18/2009 Wife became USC

12/18/2009 Sent AOS packet to Chicago

12/18/2009 Request I-130 upgrade to California

12/23/2009 Check posted for AOS

12/28/2009 NOA-I for AOS from MSC

01/04/2010 Got mail back about I-130 upgrade without any action

01/06/2010 Called 1-800-375-5283 for I-130 upgrade

Hello all,

How does the delay in I-130 affects my case for AOS or EAD?

AOS cannot be approved until the I-130 is approved so there is certainly a possible effect there...

AFAIK, unless there is a reason (such as an RFE) for the I-485 to suspend, the EAD should process ...
