Hi guys,

I had my I360 VAWA approved in July,08. I filled I485 right after that and I had my interview in the DC field office in January, 09. I have not heard from USCIS since then. I made info pass appointment and they told me that my file was sent back to the Vermont Service Center in February, 09. Is this a normal procedure? How long does it take to receive an answer after the interview?

It's not normal for it to be sent back to vermont... Usually when they send your file back to vermont is for it to be re-adjudicated.

N-400 Naturalization

04th Dec, 2012 - N-400 filed

12th Dec, 2012 - NOA Received

14th Dec, 2012 - Biometrics Letter Received

26th Dec, 2012 - Biometrics Completed

11th Jan, 2013 - Placed inline for Interview

07th Mar, 2013 - Scheduled for interview

16th Apr, 2013 - Interview Date

16th Apr, 2013- US Citizen (End of USCIS Journey)

How was the interview conducted? and did the officer approved your case or not?

She asked me all the question from the I-485 application and told me that she will need more time to make a decision on this case.

:bonk: Maybe they sent your case back to Vermont Service center for Re-adjudication/Revocation. Did you get married before your I-360 got approved or did you commit any crime ? Maybe you answered some questions that triggered them to caution in approving your I-485. Because if Vermont Service Center already approved your case you should be fine unless your local immigration office that interviewed you has or got new facts and evidence against you that might make your already approved petition deniable or that might make you ineligible for the petition. Well write a letter to Vermont Service Center and inquire what happen or contact your lawyer because am smelling some fish here. Tell your lawyer to file Application for Action on an Approved Application or Petition I-824 or you might file it yourself. Take Immediate action before its too late. Good luck !

Thank you Victoryismine, you are very helpful. I did not get married after the approval and I have a clean criminal record. I've been in deferred status since the I360 approval.

I don't know if I-824 will be helpful, considering that my I-485 has not been approved yet.

But your I-360 already approved. I-824 will be helpful because it will make them to take a quick action on your I-485 because your already approved petition I-360 is linked with it. I-360 is your visa petition to be in Permanent Adjusted Status. The essence of I-824 is to make the adjudicator to speed up his/her action on the application/petition that approved petition is liked with if its already approved. Am telling you all this because there shouldn't be a delay if you already have I-360 approved. Vermont Service Center already transfered your approved I-360 to your local immigration office for Adjustment of status adjudication. But it was returned back to Vermont Service Center that is a RED FLAG right there. I will encourage you to get a good lawyer ASAP to find out what happen with your case. You can get a fee waiver on I-824 if you can't afford it. Good luck !

It's not normal for it to be sent back to vermont... Usually when they send your file back to vermont is for it to be re-adjudicated.

how do you check whether is your case is touched or not me too am going the same process?

thanks for sharing your story with us how do we check whether your case is touched or not also i filed mine on november have aprima facie which is suppossed to expire on may 5 hope i will hear from them soon!!!

You can extend your prima f. for six months. Probably is gonna take them about 1 year to make a decision.

After you get your Noa1 they will send you somthing in the mail, prima facie I got my about 3 weeks after I mailed it off. When you get that it will give you a reciept number. Go to www.USCIS.gov on the side you will see something that says check my status. you can put that account number in and it will tell you where you are in the system. This will only tell you the basic. If you want to know if it has been touched you need to make an account so when you sign in you will see your account... something like EAC#XXOXOXO/ email updates/ mobile updates/ last updated/ etc.... where it says last updated, if that date has changed since you last looked at it, It has been "touched" updated. Hope this helps.
