My husband was arrested on domestic violence charges and was issued Protective Orders by the State. He was rearrested and was also found to be in violation of the protective order (felony). All charged were Nollied by the State and will be expunged after 13 months. We disclosed the arrests on the application to adjust state (I-485). We went to the AOS interview at the local field office and were asked to provide copies of the police reports and protective order, which by the way had already been submitted with the I-485. The interviewer noted that because he had been in violation of the protective order that he would most likely be deported and then discussed with us options for appeals. No stamp was placed in his passport. The interview concluded and we are now awaiting a decision as she indicated that she would not be able to approve the AOS and that it would be escalated to a supervisor for review and decision.

Has anyone had a similar experience involving multiple arrests and/or protective orders? While we are not a perfect couple, we are definitely in a bonafide marriage (Interviewer acknowledged that.) and would just like to know that there is hope. At this point it's a 50/50 chance of approval or denial. Serious responses appreciated.

I'm a bit confused. Were you involved in the Domestic violence charges?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
