My son is USC and born in the Philippines but we are now here in USA, we got his citizenship by filing birth abroad. My question is how long can he stay in Philippines? since we are planning to go there for more than a month. And I don't what to pay for over staying.

09/17/07----I29F package sent to CSC

09/28/07----NOA1 received

02/08/08----petition approved online

02/14/08----NOA2 hardcopy received

02/22/08----NVC received/ MNL200855....

05/13/08----gave birth to a baby boy!

06/23 &25/08----medical passed

07/01/08----interview approved but they returned my passport

07/01/08----picked up forms for crba

07/02/08----request for advance endorsement of bc

07/28/08----got BC from NSO

08/25/08----got papers from fiance

08/26/08----CRBA interview( request for DNA test)

check this out I think it applies to you, although it wont be an immigrant per say...i forget what they call it, but it is up to a year:

13(A) The wife or the husband or the unmarried child under twenty-one years of age of a Philippine citizen, if accompanying or following to join such citizen;

Checklist of Requirements for Non-Quota Immigrant by Marriage Under Section 13(a)

Duly notarized letter of application by the Filipino spouse;

General Application Form duly accomplished and notarized (BI Form No. MCL-07-01);

NSO authenticated copy of Birth certificate of Filipino spouse;

NSO authenticated copy of the Marriage Contract of alien and Filipino spouse or authenticated by the Philippine embassy/consulate nearest to or in the place where the marriage was solemnized;

Bureau of Immigration (BI) Clearance Certificate; and

Plain photocopy of passport of alien spouse showing dates of arrival and authorized stay.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Your son, having been born in the Philippines is a dual national and will be given a "balikbayan" stamp. He can stay in the Philippines for one year, visa free, with a US passport. If he has a Philippine passport, he can stay as long as he wants.

The Balikbayan Program of the Philippines was enacted in November 1989 to attract and encourage overseas Filipinos to visit the Philippines.

The following categories of persons can avail of the Balikbayan privilege: (i) a Filipino citizen who has been continuously out of the Philippines for a period of at least one (1) year from the date of last departure; (ii) a Filipino overseas worker (OFW); (iii) a former Filipino citizen who had been naturalized in a foreign country and holds a foreign passport.

A 'Balikbayan' is entitled to the following benefits:

a. Travel Tax exemption;

b. Visa-free entry to the Philippines for a period of one (1) year, for a foreign passport holder;

The Balikbayan privilege is extendible to legitimate members of the family (i.e. spouse and children) of individuals in the above-mentioned categories, who are holders of Filipino passports ONLY IF they a re travelling to the Philippines together with the above-mentioned qualified individual.

It can also be availed of by legitimate members of the family (i.e. spouse and children) of individuals in the above-mentioned categories, who are aliens or holders of foreign passports, ONLY IF they are travelling to the Philippines together with the above-mentioned qualified individual.

In order to avail of the privilege, qualified Filipino citizens need to present only their Philippine passports showing the date of last exit from the Philippines, which should not be less than 1 year. Aside from their foreign passports showing date of last exit from the Philippines, former Filipino citizens need to present their old Philippine passport or Philippine birth certificate. In the absence of these documents, they can present foreign naturalization papers to show former Philippine citizenship or certification from adopted country.

Family members of the former Filipino citizen who are travelling with the Balikbayan should present passports and any of the following: a) birth certificate, in case of children; b. marriage certificate, in case of spouse; c) adoption papers, in case of legally adopted children.
