Timeline

Can someone advise me on the best course of action because myself I don’t know what to do anymore.

I have – HOA 1 - April 11

HOA 2 - April 18

My docs were sent to the US embassy in Moscow and returned back to the states due to the new law. I called the Vermont center but they cannot even tell me for sure where my petition is. I have not received an RFE yet and my case was last updated on 05/01/2006 and that is it. When I talked to the customer service and I asked her if I should reapply because maybe my docs were lost, then she said no, your docs are somewhere here. What kind of respond it is???????? What should I do? Reapply or continue waiting for my FRE. Please someone advice. Thanks a lot.

There have been quite a few cases that got recalled due to IMBRA. You may want to check these threads: http://www.visajourney.com/forums/index.php?showtopic=20652 - it shows some of the recalled cases and the updates we got; and

http://www.visajourney.com/forums/index.php?showtopic=22563 - for those cases that have been misplaced - some good advice in here.

I wouldn't file again because they do have your case somewhere and until you haven't gotten an official notice that states it's been lost, your case is theoretically being processed. If you filed again, odds are it'd cause even more delays because they'd get two cases with the same applicant/beneficiary in their system.

I only offer advice - not even legal. Just the plain and simple kind.

I agree with mew, DO NOT REFILE UNTIL YOU ARE POSITIVE IT IS LOST.

Only recourse you have now is to keep calling and contact your congressman to try and get them to ask the question. It has been a waiting game for alot of people and there are quite a few still waiting for their RFE so dont feel alone.

20 Aug 09 Tickets purchased for 10 Sep 09

WE HAVE FINALLY WON, OUR LONG AND HARD JOURNEY IS COMPLETE!!!!!!
